1. Acceptance of Terms

By accessing, downloading, or using the SakayPH mobile application, website, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and SakayPH ("Company," "we," "us," or "our"). By using our Services, you represent that you are at least 18 years of age and have the legal capacity to enter into this agreement.

2. Services Description

SakayPH provides a technology platform that connects passengers ("Riders") with independent third-party transportation providers ("Drivers"). We offer various transportation options including:

• Motorcycle Taxi: Single-passenger motorcycle transportation service
• Tricycle Ride: Short-distance tricycle transportation for up to 3 passengers
• Car Ride: Four-wheel vehicle transportation for up to 4 passengers

SakayPH does not provide transportation services directly. We are a technology company that facilitates connections between Riders and independent Drivers. Drivers are not employees, agents, or representatives of SakayPH.

3. User Responsibilities

As a user of SakayPH Services, you agree to:

• Accurate Information: Provide true, accurate, current, and complete information during registration and keep your account information updated
• Account Security: Maintain the confidentiality and security of your account credentials and immediately notify us of any unauthorized use
• Legal Compliance: Use the Services in compliance with all applicable local, state, national, and international laws and regulations
• Respectful Conduct: Treat Drivers with respect and courtesy. Harassment, abuse, or discrimination will not be tolerated
• No Unauthorized Use: Not use the Services for any illegal, fraudulent, or unauthorized purpose
• Age Requirement: You must be at least 18 years old to use the Services independently. Minors must be accompanied by an adult

4. Payments and Fees

By using our Services, you agree to the following payment terms:

• Fare Calculation: Fares are calculated based on base fare plus distance traveled and waiting time. The estimated fare is displayed before you confirm your booking
• Payment Methods: We accept cash payments and digital wallet payments through the SakayPH platform
• Wallet Top-Up: You may load funds into your SakayPH wallet using authorized payment channels including GCash, Maya, bank transfer, and over-the-counter payment centers
• Payment Obligation: You agree to pay all applicable fares, fees, and charges associated with your use of the Services
• Pricing Changes: We reserve the right to modify our pricing structure at any time. Changes will be communicated through the app or website

5. Cancellation Policy

Our cancellation policy is designed to be fair to both Riders and Drivers:

• Free Cancellation: You may cancel your booking within 2 minutes of making the reservation without any charge
• Cancellation Fee: A cancellation fee of ₱20 may apply if you cancel after 2 minutes of booking or if the driver has already arrived at the pickup location
• No-Show Policy: If you fail to show up at the pickup location after the driver has waited for 5 minutes, you may be charged a no-show fee equivalent to the minimum fare
• Driver Cancellation: If a Driver cancels your booking, you will not be charged, and we will help you find another Driver
• Refund Policy: Refunds for cancelled bookings will be processed within 3-5 business days for wallet payments

6. Limitation of Liability

To the fullest extent permitted by applicable law:

• SakayPH acts solely as a technology platform connecting Riders with independent Drivers and is not a transportation carrier
• We are not responsible for the conduct, actions, or omissions of Drivers or other Users
• We do not guarantee the quality, safety, or reliability of transportation services provided by Drivers
• Our total liability for any claim arising from the use of our Services shall not exceed the amount paid by you for the specific ride giving rise to the claim
• We are not liable for any indirect, incidental, special, consequential, or punitive damages

7. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the collection and use of your data as described in our Privacy Policy.

We implement reasonable security measures to protect your personal information. However, no method of electronic storage or transmission is 100% secure, and we cannot guarantee absolute security.

8. Account Termination

We reserve the right to:

• Suspend or terminate your account at any time for violation of these Terms or any applicable law
• Modify, suspend, or discontinue any aspect of the Services at any time without prior notice
• Remove or refuse any content you submit to the platform

You may terminate your account at any time by contacting our support team. Upon termination, your right to use the Services will immediately cease.

9. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website or app. Your continued use of the Services after any modifications indicates your acceptance of the updated Terms.

We encourage you to review these Terms periodically for any changes. Material changes will be communicated through the app or via email.
